Duty is charged on the higher of your sale price and the guideline value. If the guideline value of the locality is above what you actually agreed to pay, you still pay duty on the guideline value. Check the guideline value before you agree a price — buyers routinely budget 11% of the sale price and are then caught short when the guideline value is higher.
The steps, in order
2. Check the guideline value for the survey number and work out the duty.
3. Draft the deed — normally through an advocate or document writer.
4. Pay stamp duty by e-stamping through TNREGINET, or through an authorised bank or franking centre.
5. Book the appointment at the correct sub-registrar office for that property.
6. Attend in person — buyer, seller and two witnesses, with photo ID; photographs and thumb impressions are captured.
7. Collect the registered document, then apply for patta transfer / mutation into your name.
What to carry on the day
- The drafted deed on stamp paper, or proof of e-stamping.
- Photo ID and PAN for buyer and seller.
- Two witnesses with their own photo ID.
- The previous title deed and the encumbrance certificate.
- Patta / chitta and, where relevant, the FMB sketch.
- Proof of stamp duty payment and the fee receipt.
- Passport photographs as required.
Registration is not the end — transfer the patta
This is the step most first-time buyers miss. Registering the sale deed records the transaction; it does not automatically update the revenue records that name you as the holder of the land. Until you apply for patta transfer, also called mutation, the revenue record may still show the seller.
That gap matters practically: patta is what you produce for a loan, a subsequent sale, or a compensation claim, and a mismatch between the registered deed and the patta is a standing obstacle. Apply for mutation soon after registration, while the paperwork and the seller's cooperation are both still fresh.
Before you sign anything
Three checks are worth more than any amount of paperwork afterwards. Confirm the seller has clear, marketable title through a long-period EC and, for a significant purchase, a lawyer's opinion. Confirm the land is what it appears to be — survey number, extent and boundaries — using survey number search and the field measurement sketch. And confirm the true cost including duty on the guideline value, so the 11% does not arrive as a surprise at the sub-registrar's counter.
How long the process takes
Registration itself is quick — the appointment at the sub-registrar office usually takes a couple of hours once everything is in order, and the registered document is typically returned within a few days. What takes time is everything before it: obtaining a 30-year encumbrance certificate (3-5 working days), drafting and checking the deed, arranging funds and paying stamp duty. Realistically, allow two to four weeks from agreeing a price to holding a registered deed, and longer if the title needs untangling.
